Ardagh Glass' appeal is thrown out

The Court of Appeal has thrown out Ardagh Glasss claim that Chester West and Cheshire Council had no power to grant retrospective planning permission for the Quinn Glass plant in Elton. The decision comes months after the end to the legal battle over the legality of the plant when the Secretary of State gave Quinn retrospective planning approval in November 2009, after the local authority approved its application the month before.
