Eurokey Recycling Ltd was formed in 1995 and since 2000 has been operating as a successful plastic recycler. During a routine credit check by one of its suppliers, a company was discovered registered as Eurokey Plastics Recycling. This company had been registered by Noman Iqbal, who is the brother of Raja Iqbal - the chairman and managing director of Choice Waste Management and a competitor of Eurokey Recycling Ltd.
As a consequence, solicitors representing Eurokey Recycling Ltd have requested that Noman Iqbal change the company name to another name not incorporating the word Eurokey. The solicitors warned that if this were not to happen, they would instigate court proceedings against Eurokey Plastics Recycling in which damages and an injunction against using the name would be sought.
Eurokey Recycling Ltd commercial director Joe Bisland told MRW: The concerns I have are that it may cause confusion to suppliers, customers, haulage companies and shipping lines. We have been going for 14 years, so it is a long established company. Choice Waste Management is a significant player in the market and both of us are in the top five companies in the sector.
In a statement emailed to MRW, Raja Iqbal said: Our accountant was given a job to form a new company. He has then passed this onto his assistant, whose explanation was that this was the best company name he could find. The change of the company name is in process and will be done within a week.
Until then, we confirm that Eurokey Plastic Recycling will not be involved in any trading whatsoever.
Legally, we have done nothing wrong and have the full right to choose any company name available with Company House. We are changing the name only because Eurokey Recycling thinks it is a threat to their business. We have taken the point and give you assurance of our cooperation.
