Sims acquisition investigated by Competition and Markets Authority

The Competition and Markets Authority (CMA) has made an initial enforcement order (IEO) on Sims Metal Management and Sims UK, after its acquisition of Morley Waste.

Sims Metal Management (SMM) announced that it had acquired Morley Waste Traders and Lord and Midgley (Morley) businesses in March.

Morley has 10 metal recycling facilities across Yorkshire, which now gives SMM 50 such facilities across the country.

IEOs prevent merging parties from taking ‘pre-emptive action’ which might prejudice the outcome of any potential investigation or the CMA’s ability to introduce any necessary measures.

The CMA said that it was considering whether the acquisition had created a merger that has resulted, or may result, in a substantial lessening of competition in the UK market.
