Localism powers to fine authorities are “confusing for waste”


As we all know, Local Authorities can contract out services, but cannot contract out liabilities - these always remain with the LA. So the LA would have to pay any fines imposed. The real question is: can LA's reclaim any / all of the cost of these fines from their "waste partners"? I suppose the answers are to be found in the Standard Operating Contracts - although only redacted versions of these contracts are available in the public domain. Maybe a kind Waste Officer could help clarify this matter...
